Terms of Service

Last updated: 26 July 2026

1. About These Terms

This website is operated by MANVAS Group Pty Ltd, ABN 43 687 505 317, trading as MANVAS Landscaping and referred to in these Terms as “MANVAS”, “we”, “us” or “our”.

These Terms apply to your use of the MANVAS website and to products purchased directly through the website.

Products, project enquiries, custom orders and services governed by a separate written MANVAS quotation, order confirmation or agreement may also be subject to additional terms stated in that document.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

2. Website Use

You may use this website only for lawful purposes.

You must not:

  • interfere with the operation or security of the website;

  • attempt to gain unauthorised access to accounts, systems or information;

  • introduce malicious software or code;

  • submit false, misleading or fraudulent information;

  • impersonate another person;

  • use website content in a way that infringes intellectual property rights; or

  • use automated systems in a way that materially disrupts the website or imposes an unreasonable load on its services.

We may reasonably restrict access where necessary to protect the website, MANVAS or other users.

3. Product Information

MANVAS takes reasonable steps to present accurate product descriptions, specifications, images and availability information.

Product images may be illustrative. Actual colour, texture, finish and appearance may vary because of:

  • screen and lighting conditions;

  • natural material variation;

  • manufacturing batches;

  • weathering;

  • product configuration; and

  • reasonable production tolerances.

Natural stone, weathering steel, WPC products, powder-coated finishes and similar outdoor materials may show natural or environmental variation.

Customers should review the applicable product description, specifications, installation requirements and written quotation before ordering.

4. General Information and Site-Specific Advice

Website information is provided as general product information. It is not site-specific engineering, structural, building, electrical or legal advice.

Product suitability may depend on site dimensions, access, structural support, drainage, waterproofing, wind exposure, installation method, local regulations and intended use.

Where professional design, engineering, certification, licensed trade work or regulatory approval is required, responsibility will be determined by the applicable written quotation or project agreement.

5. Direct-Purchase and Enquiry Products

Some MANVAS products can be purchased directly through the website.

Other products are displayed on an enquiry-only basis because their final configuration, dimensions, freight, installation requirements or project conditions must be confirmed before sale.

Submitting an enquiry does not create a purchase contract or require either party to proceed.

An enquiry-only product is supplied only after MANVAS issues and the customer accepts an applicable written quotation or order confirmation.

6. Prices and GST

Unless expressly and lawfully stated otherwise, consumer prices displayed on the MANVAS website are in Australian dollars and include GST.

Delivery, special unloading, installation, site preparation, concrete foundations, electrical work, customisation and other project-specific costs are not included unless expressly stated.

Where delivery can be calculated accurately, it may be displayed at checkout. Where it cannot be calculated accurately, MANVAS will confirm it separately before the order is finalised.

Written trade or project quotations will specify whether GST is included or added separately.

7. Pricing and Information Errors

MANVAS takes reasonable steps to keep product and pricing information accurate.

If we identify a genuine pricing, description, availability or configuration error before accepting an order, we may pause the order and contact the customer to:

  • confirm the corrected information;

  • offer an appropriate alternative; or

  • decline the order and refund any amount already paid.

We will not substitute products or increase an accepted order price without the customer’s agreement, except where permitted by law or provided for in an applicable written agreement.

Nothing in this section limits rights relating to multiple or misleading price displays under the Australian Consumer Law.

8. Orders and Acceptance

Submitting an online order is an offer to purchase.

An automated payment receipt or order acknowledgement confirms that the order was received but does not necessarily confirm final acceptance.

An order is accepted when MANVAS confirms acceptance in writing or begins fulfilment, whichever occurs first.

Before acceptance, MANVAS may reasonably decline an order because of:

  • unavailable stock;

  • an incorrect or incomplete product configuration;

  • an inability to arrange suitable delivery;

  • suspected fraud;

  • a genuine pricing or website error; or

  • legal or safety restrictions.

If MANVAS declines an order after receiving payment, the amount paid will be refunded to the original payment method.

9. Product Availability

Product availability and inventory information may change.

If a purchased product becomes unavailable, MANVAS will contact the customer and offer an appropriate solution, which may include:

  • an updated estimated supply date;

  • an alternative product accepted by the customer; or

  • cancellation and refund of the unavailable item.

MANVAS will not replace an ordered product with a materially different product without customer approval.

10. Payment

Customers must provide complete and accurate billing, delivery and contact information.

The customer confirms that they are authorised to use the selected payment method.

Orders may be held until payment is successfully processed or other written payment arrangements are confirmed.

Any refund will normally be made to the original payment method unless another method is agreed or required by law.

11. Delivery

Delivery is governed by the MANVAS Shipping and Delivery Policy and any product-specific written quotation or order confirmation.

Delivery charges, vehicle requirements and unloading arrangements may depend on product size, weight, destination, site access and carrier requirements.

Delivery does not include installation, assembly, placement inside a property, crane services, forklift services or removal of packaging unless expressly agreed in writing.

Estimated delivery dates are not guaranteed, but MANVAS will comply with obligations that apply where goods are not supplied within an agreed or reasonable time.

12. Customer Collection

Collection from the MANVAS warehouse is available by appointment for eligible products.

Customers must wait for confirmation that an order is ready before attending.

The customer is responsible for providing a suitable vehicle and appropriate load restraint. MANVAS may decline to load or release goods where the proposed transport arrangement is reasonably considered unsafe.

13. Custom, Cut-to-Size and Special-Order Products

Custom-made, cut-to-size, specially finished, personalised or specially sourced products may only be produced after the required specifications and payment arrangements are confirmed.

Customers are responsible for checking dimensions, configuration, colour and other approved details before production begins.

Change-of-mind cancellation or return rights may be limited once production, cutting, customisation or special sourcing has commenced.

This does not affect rights relating to faulty, damaged, incorrectly supplied or non-compliant products under the Australian Consumer Law.

14. Project Services and Installation

Installation, site measurement, design support, project coordination or other services are included only where expressly stated in a written MANVAS quotation or agreement.

Unless expressly included, product pricing does not include:

  • demolition or removal of existing work;

  • concrete footings or foundations;

  • electrical or plumbing work;

  • structural engineering or certification;

  • permits or approvals;

  • rectification of unsuitable site conditions;

  • difficult-access equipment;

  • crane or forklift services; or

  • work caused by inaccurate customer-supplied information.

The applicable written quotation will identify the confirmed scope, assumptions, exclusions and any customer responsibilities.

15. Variations and Additional Work

If site conditions, measurements, access requirements or customer instructions differ materially from the information used to prepare a quotation, MANVAS may propose a written variation.

Additional work or charges must be communicated and agreed before that additional work proceeds, except where immediate action is reasonably required to address a safety risk or prevent damage.

16. Cancellations, Returns and Refunds

Cancellations, change-of-mind returns, faulty products, refunds and exchanges are governed by the MANVAS Returns, Refunds and Cancellations Policy and the Australian Consumer Law.

Customers should contact MANVAS promptly if they wish to change or cancel an order.

A requested change or cancellation is not confirmed until accepted by MANVAS in writing.

17. Consumer Guarantees and Product Warranties

MANVAS products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund, cancellation or compensation where goods or services fail to meet an applicable consumer guarantee.

Any MANVAS product warranty is an additional promise and does not replace or limit Australian Consumer Law rights.

Product-specific warranty periods, conditions, exclusions and claim procedures apply only where stated in an applicable written MANVAS warranty document.

18. Product Installation and Maintenance Requirements

Product performance may depend on correct storage, handling, installation, use and maintenance.

Where a product has a MANVAS installation guide or maintenance guide, customers and installers should follow that document.

Damage caused by misuse, unsuitable site conditions, incorrect installation or unauthorised modification may not constitute a product defect. This does not affect rights that cannot lawfully be excluded.

19. Third-Party Products and Services

The website may contain links to third-party websites or use services provided by Shopify, payment processors, carriers and other service providers.

Those third parties may have their own terms and privacy policies.

MANVAS remains responsible for its obligations as the seller and will not direct customers away from rights that MANVAS must provide under the Australian Consumer Law.

20. Relationship with Shopify

The MANVAS online store is hosted and supported by Shopify.

Products sold through the store are sold by MANVAS, not Shopify. Questions concerning MANVAS products, orders, delivery, returns or services should be directed to MANVAS.

Shopify may process information and provide technical, payment or ecommerce services according to its applicable terms and privacy practices.

21. Intellectual Property

Unless otherwise stated, website text, product descriptions, MANVAS branding, graphics, photographs, videos, drawings, layouts and other original content are owned by or licensed to MANVAS.

Website content may be viewed for personal or legitimate business purchasing purposes.

It must not be reproduced, republished, commercially exploited or used to misrepresent an association with MANVAS without prior written permission.

Third-party names and trademarks remain the property of their respective owners.

22. Privacy

Personal information is handled according to the MANVAS Privacy Policy and applicable privacy laws.

Information may also be processed by Shopify, payment providers, carriers and other service providers where reasonably required to operate the website, process orders, arrange delivery or respond to enquiries.

23. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability under the Australian Consumer Law.

To the extent permitted by law, MANVAS is not responsible for loss caused solely by:

  • customer misuse or unauthorised modification;

  • incorrect information supplied by the customer;

  • failure to follow applicable installation or maintenance requirements;

  • site conditions outside the agreed scope; or

  • third-party work not supplied or controlled by MANVAS.

Any limitation of liability in a separate written quotation or agreement applies only to the extent permitted by law.

24. Changes to These Terms

MANVAS may update these Terms to reflect changes to the website, products, operations or applicable law.

Changes apply prospectively from the date the updated Terms are published.

Changes will not retrospectively alter an order or quotation already accepted unless:

  • both parties agree;

  • the accepted agreement permits the change; or

  • the change is required by law.

25. Order Documents and Priority

For direct website purchases, these Terms should be read together with:

  • the applicable product information;

  • the order confirmation;

  • the Shipping and Delivery Policy;

  • the Returns, Refunds and Cancellations Policy;

  • the Privacy Policy; and

  • any applicable written product warranty.

For quotation-based or project orders, the applicable written MANVAS quotation or agreement will take priority where it expressly differs from these general website Terms, subject to the Australian Consumer Law.

26. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia.

The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights concerning jurisdiction that cannot lawfully be excluded.
